By accessing or using the website leominsterconcreteco.com (the "Site") or by engagingLMC Leominster Concrete ("we," "our," or "us") for concrete contracting services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Site or engage our services.
These Terms and Conditions apply to all visitors to the Site and to all customers who enter into a service agreement with LMC Leominster Concrete.
LMC Leominster Concrete provides concrete contracting services, including but not limited to concrete driveway construction, patio installation, foundation work, sidewalks, retaining walls, stamped and decorative concrete, garage floors, pool decks, steps, parking lots, concrete footings, and concrete cutting. Services are performed in Leominster, Massachusetts, and surrounding communities as agreed upon in writing at the time of contracting.

All estimates provided by LMC Leominster Concrete are free and non-binding unless confirmed in writing as a formal contract or agreement. Estimates are based on conditions observed at the time of the site visit and the scope of work described at that time.
If site conditions change or the scope of work expands after an estimate is issued, the final price may differ from the estimate. We will notify you of any material changes before proceeding with additional work. Estimates do not constitute a guarantee of final cost.
Prices quoted are for the specific scope, materials, and conditions described in the written estimate. Requests for changes or additions after work has begun may result in additional charges, which will be communicated to you in advance.
Scheduling is subject to availability and weather conditions. Concrete placement requires temperatures appropriate for proper curing. We reserve the right to reschedule work if conditions — including weather, material availability, or unforeseen site issues — make it unsafe or impractical to proceed as planned. We will communicate any such changes to you as promptly as possible.
If you need to cancel or reschedule a confirmed appointment, please contact us as soon as possible. Cancellations made less than 48 hours before a scheduled start date may result in a fee if materials have already been ordered or preparations made. Specific cancellation terms will be outlined in your written service agreement.
Payment terms are specified in each individual service agreement. Unless otherwise stated in writing, a deposit may be required before work begins, with the balance due upon completion of the project. Accepted payment methods will be communicated at the time of contracting.
Invoices not paid by the due date are subject to a late fee as specified in the written service agreement. LMC Leominster Concrete reserves the right to suspend or discontinue work on any project where payment obligations are not met.
All deposits are non-refundable if work has commenced or if materials have been ordered specifically for your project. Refund eligibility will be outlined in your individual service agreement.
Where required by local ordinance or regulation, LMC Leominster Concrete will obtain the necessary permits before beginning work. Permit fees, where applicable, will be disclosed in the written estimate or service agreement. The customer is responsible for ensuring that the project site is accessible and that there are no deed restrictions, homeowner association rules, or other encumbrances that would prevent the work from being performed.
You are responsible for ensuring that the work area is accessible to our crew and equipment on the scheduled start date. This includes removing vehicles, personal property, landscaping, or obstructions from the work area before arrival. Failure to do so may result in delays or rescheduling at additional cost.
You are also responsible for informing us of any known underground utilities, buried structures, or site conditions that could affect the work. While we call for utility marking services as required, you remain responsible for disclosing any private utilities not covered by standard marking programs.
LMC Leominster Concrete warrants that work will be performed in a workmanlike manner using materials suitable for the project. Any warranty terms will be stated in your written service agreement.
Concrete is a natural material that is subject to cracking, color variation, and surface wear over time, particularly in climates with significant freeze-thaw cycles. These natural characteristics do not constitute defects and are not covered under any warranty. We are not responsible for issues resulting from improper maintenance, misuse, acts of nature, failure to seal the surface as recommended, or conditions beyond our control.
The Site and its content are provided "as is" without warranty of any kind. We make no representations regarding the accuracy, completeness, or fitness for a particular purpose of any information on the Site.
To the maximum extent permitted by applicable law, LMC Leominster Concrete shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of this Site or from our services, including but not limited to loss of profits, loss of use, or property damage not directly caused by our negligence.
Our total liability for any claim arising from services rendered shall not exceed the amount paid by you for the specific services giving rise to the claim.
In the event of a dispute arising from these Terms and Conditions or from services provided by LMC Leominster Concrete, the parties agree to first attempt to resolve the dispute through good-faith communication. If a resolution cannot be reached informally, the parties may pursue mediation before initiating any formal legal proceedings.
Nothing in this section prevents either party from seeking emergency injunctive or equitable relief where appropriate.
These Terms and Conditions are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any legal action or proceeding arising from these terms shall be brought in a court of competent jurisdiction located in Worcester County, Massachusetts.
We reserve the right to update or modify these Terms and Conditions at any time. When we do, we will revise the effective date at the top of this page. Your continued use of the Site or engagement of our services after any change constitutes your acceptance of the updated terms. Please review this page periodically.
